SOL: two years from diagnosis (ORS 30.907(1)) Courts: Multnomah County Circuit Court (Portland), Marion County Circuit Court (Salem) Oregon has an asbestos-specific statute of limitations. ORS 30.907(1) requires a product liability action for damages from asbestos-related disease to be commenced within two years after the date on which the plaintiff first discovered, or reasonably should have discovered, the disease and its cause. For a death, do not assume the clock runs from the date of death: ORS 30.020(1) requires the action to be commenced within three years after the injury causing the death is discovered or reasonably should have been discovered, and because a product liability civil action in Oregon includes an action for death, an asbestos death claim may instead fall under the two-year period in ORS 30.907.
